Can You Get Social Security Disability While Receiving Unemployment In Florida?

Maybe

Chronic pain, reduced mobility, and other symptoms of chronic illnesses or injuries can make working difficult. If you are let go from your current job, it can be challenging to find another. Filing for unemployment may be an option. You may also be able to get Social Security disability benefits.

Can you get both? Our experienced Jacksonville Social Security disability lawyer explains when it might be possible and the conflicting requirements that could jeopardize your rights to both benefits.

Florida Social Security Disability and Unemployment Benefits: Two Programs With Opposite Requirements

If you lose your job in Florida, you may be entitled to unemployment benefits, which reimburse up to 50 percent of your prior wages. Filing for Social Security disability may also be an option if you suffer a condition that prevents you from working for a year or longer. The program reimburses up to two-thirds of your income.

Collecting both types of benefits might seem like the best way to make up for what you lost. However, the problem is that unemployment and Social Security Disability Insurance (SSDI) are built on conflicting principles. Here’s the problem:

  • To qualify for unemployment in Florida, you must certify that you are ready, willing, and able to work.
  • To qualify for SSDI, you must demonstrate that a medical condition prevents you from working.
  • Both the SSA and Florida’s unemployment agency track dual claims.
  • Filing claims through both agencies could result in the denial of all benefits.

Understanding these risks before filing is critical. Timing and documentation can make or break your claim.

When You May Be Able To Collect Both Unemployment and Social Security Disability in Florida

There are limited situations in which you can receive both types of benefits. For example, if your condition worsens over time and you transition from unemployment to disability benefits, or if you are earning below the SSA’s Substantial Gainful Activity (SGA) threshold, which is $1,690 per month (for non-blind individuals) in 2026.

If your earnings stay below that amount, the SSA may not consider you capable of full-time work. Additional considerations include:

  • Any income you receive, including unemployment, must be reported to the SSA.
  • Unlike some other states, Florida does not reduce Social Security disability payments for those receiving unemployment.
  • Under the SSA’s Trial Work Period, you can work for up to nine months without immediately losing benefits.
  • Refusing work can result in denied unemployment benefits.

To avoid jeopardizing your eligibility for either program, discuss your options with an experienced Florida disability lawyer before taking any actions.
